Het waren de staatsveiligheidsorganen in Shanghai die Fu Cha meenamen; het moment was niet de grenscontrole bij binnenkomst, maar de periode waarin hij het schrappen van zijn huishoudregistratie regelde, zodat een administratieve procedure de toegangsweg tot hem werd. De Eerste Intermediaire Volksrechtbank van Shanghai deed op 17 februari 2025 uitspraak in eerste aanleg; de behandeling was niet openbaar, de familie en de uitgeverij kregen geen juridische documenten, en het openbaar gemaakte materiaal vermeldt evenmin welk openbaar ministerie de zaak voerde of wat de tenlastelegging inhield.

Het gevangeniswezen voerde de straf van drie jaar uit tot die in mei 2026 afliep; daarna geldt nog steeds de bijkomende ontzetting uit de politieke rechten voor één jaar, en door de uitreiscontrole kan hij niet naar Taiwan terugkeren. Wie de zaak naar buiten toe heeft toegelicht, is het Bureau voor Taiwanese Zaken van de Staatsraad en niet de rechtbank; rechterlijke stukken zijn tot op heden niet te zien geweest.

Analyse van mensenrechten en rechtsstaat

De gedraging waarvoor Fu Cha ter verantwoording is geroepen, is uitgeefwerk dat in Taiwan volgens de wet werd verricht en dat valt onder de vrijheid van meningsuiting en van publicatie die door internationale mensenrechtennormen wordt beschermd; die bescherming vervalt niet doordat hij later Chinees grondgebied betrad. Deze feitenketen laat zien dat legale uitgeefactiviteit in het buitenland is omgezet in strafrechtelijke aansprakelijkheid voor de staatsveiligheid binnenslands: uitgegeven in Taipei, aangehouden in Shanghai, ten laste gelegd als “aanzetten tot afscheiding”. De autoriteiten hebben de concrete uitlatingen waarop de tenlastelegging berust niet openbaar gemaakt, terwijl Human Rights Watch de zaak heeft vastgelegd als de gevangenzetting van een Taiwanese uitgever en zijn vrijlating heeft geëist. Tot de geschonden rechten behoren de vrijheid van meningsuiting en van publicatie, de persoonlijke vrijheid, een openbaar en eerlijk proces, de inzage in het dossier door familie en verdediging, en de bewegings- en uitreisvrijheid na het uitzitten van de straf. De structurele oorzaken zijn dat de delictsomschrijvingen in de staatsveiligheidswetgeving ruim zijn, dat de behandeling besloten mag zijn en het vonnis niet hoeft te worden gepubliceerd, waardoor toezicht van buitenaf stelselmatig is uitgesloten. De Chinese overheid moet de tenlastelegging en het vonnis openbaar maken, de familie en de raadsman volledige inzage in het dossier geven, het uitreisverbod opheffen en hem laten terugkeren naar Taiwan.

Beschermingsrisico's

De identiteit van Fu Cha was volstrekt openbaar: hij was de bij naam bekende hoofdredacteur van een uitgeverij, het fonds en de uitgeefactiviteiten zijn al lang na te gaan, en om hem te identificeren was geen geheim onderzoek nodig. Zijn band met China bestond uit familie en huishoudregistratie: juist het schrappen van die registratie, een noodzakelijke formaliteit om de Taiwanese identiteit te verkrijgen, bracht hem rechtstreeks binnen een rechtsmacht waar hij kon worden vastgehouden. De familie en zijn collega's krijgen het vonnis en het bewijsmateriaal niet in handen, en volgens het Bureau voor Taiwanese Zaken ging hij niet in hoger beroep en werd het vonnis van rechtswege onherroepelijk; in die lezing bestaat er binnen het Chinese rechtsstelsel geen gewone rechtsgang meer. Het aflopen van de straf hief de controle evenmin op: hij mag het land nog steeds niet verlaten en daarnaast geldt de bijkomende ontzetting uit de politieke rechten, wat laat zien dat de autoriteiten ook na afloop van de detentie het vermogen behouden hem te identificeren en onder druk te zetten. Voor wie in het buitenland publiceert of schrijft maar in China nog een huishoudregistratie of familiebanden heeft, kan een routinematige administratieve procedure zelf het risicopunt worden.

È nato nel Liaoning, dal 2013 risiede stabilmente a Taiwan e all'inizio del 2023 ha ottenuto l'identità taiwanese; il viaggio a Shanghai serviva sia a far visita ai familiari sia a completare la cancellazione anagrafica richiesta per acquisire la cittadinanza taiwanese. La contraddizione che più richiede una spiegazione è questa: le autorità lo hanno condannato per un grave reato contro la sicurezza dello Stato, ma non hanno mai reso pubbliche le espressioni o le pubblicazioni concrete su cui si fonda l'atto di accusa, e né la famiglia né Gusa Publishing hanno mai ottenuto la sentenza o il materiale probatorio.

Dal prelevamento al passaggio in giudicato della sentenza sono trascorsi quasi due anni, e dall'esterno non è dato sapere come si sia svolto il procedimento; solo poco più di un mese dopo la condanna l'Ufficio per gli affari di Taiwan del Consiglio di Stato cinese ha confermato pubblicamente l'entità della pena. Secondo una fonte citata da CNA, è uscito dal carcere a fine pena nel maggio 2026; gli resta vietato lasciare il paese e non può rientrare a Taiwan, e resta inoltre soggetto alla pena accessoria della privazione dei diritti politici.

Le dichiarazioni della famiglia e di Gusa Publishing confermano un dato di fatto: in tutto il procedimento la parte cinese non ha mai consegnato la sentenza, l'atto di accusa o il materiale probatorio, sicché le espressioni per cui è stato condannato non sono verificabili. Human Rights Watch documenta il processo segreto e l'assenza dei documenti giudiziari; CNA e Taipei Times documentano il tribunale che ha giudicato il caso, la data della sentenza, la durata della pena e l'ammontare della confisca; il sito in inglese di CNA documenta l'arresto del 21 marzo 2023, la fine della pena nel maggio 2026 e il divieto di espatrio dopo la scarcerazione.

Il solo materiale reso pubblico dalle autorità è la conferma orale dell'Ufficio per gli affari di Taiwan del 26 marzo 2025, e la sentenza non è stata finora pubblicata.

L'opinione pubblica conosce il caso unicamente attraverso la versione unilaterale di un organo politico, e non è possibile accertare a quale libro o a quale passaggio si riferisca l'«istigazione alla secessione».

Pressione sull’azione di difesa e intervento statale

A prelevare Fu Cha sono stati gli organi di sicurezza dello Stato di Shanghai; il momento non è stato il controllo di frontiera all'ingresso, ma il periodo in cui sbrigava la pratica di cancellazione anagrafica, sicché una procedura amministrativa è diventata la via d'accesso a lui. Il Primo Tribunale popolare intermedio di Shanghai ha emesso la sentenza di primo grado il 17 febbraio 2025; il dibattimento non si è svolto in pubblico, la famiglia e la casa editrice non hanno ricevuto alcun documento giudiziario e il materiale reso pubblico non indica neppure quale procura abbia istruito il caso né quale fosse il contenuto dell'atto di accusa.

Il sistema penitenziario ha eseguito i tre anni di pena fino alla scadenza nel maggio 2026; da allora resta in vigore la pena accessoria di un anno di privazione dei diritti politici, e i controlli sull'espatrio gli impediscono di rientrare a Taiwan. A illustrare il caso all'esterno è stato l'Ufficio per gli affari di Taiwan del Consiglio di Stato e non il tribunale, mentre gli atti giudiziari non sono mai stati resi visibili.

Analisi dei diritti umani e dello Stato di diritto

La condotta per cui Fu Cha è stato perseguito è un'attività editoriale svolta legalmente a Taiwan, che rientra nella libertà di espressione e di pubblicazione tutelate dagli standard internazionali sui diritti umani e non perde tale tutela per il fatto che egli sia poi entrato nel territorio cinese. Questa catena di fatti mostra come un'attività editoriale legale all'estero sia stata trasformata in responsabilità penale per la sicurezza dello Stato all'interno del paese: pubblicazione a Taipei, arresto a Shanghai, imputazione di «istigazione alla secessione». Le autorità non hanno reso pubbliche le espressioni concrete su cui si fonda l'atto di accusa, mentre Human Rights Watch ha registrato il caso come la carcerazione di un editore taiwanese e ne ha chiesto la scarcerazione. Tra i diritti lesi figurano la libertà di espressione e di pubblicazione, la libertà personale, il processo pubblico ed equo, l'accesso al fascicolo da parte della famiglia e della difesa e, a pena scontata, la libertà di circolazione e di espatrio. Le cause strutturali stanno nell'ampiezza delle fattispecie in materia di sicurezza dello Stato, nella possibilità di celebrare il processo a porte chiuse e di non pubblicare la sentenza, con l'effetto di escludere in modo sistematico ogni controllo esterno. Il governo cinese deve rendere pubblici l'atto di accusa e la sentenza, consegnare alla famiglia e al difensore l'intero fascicolo, revocare il divieto di espatrio e consentirgli di rientrare a Taiwan.

Rilevanza per l’esame della protezione

L'identità di Fu Cha era del tutto pubblica: era il direttore editoriale di una casa editrice, indicato per nome, il catalogo e l'attività editoriale sono da tempo consultabili e per identificarlo non serviva alcuna indagine riservata. Il suo legame con la Cina erano la famiglia e la registrazione anagrafica: proprio la cancellazione anagrafica, formalità indispensabile per ottenere l'identità taiwanese, lo ha portato direttamente dentro una giurisdizione in cui poteva essere detenuto. I familiari e i colleghi non riescono a ottenere la sentenza né il materiale probatorio e, secondo l'Ufficio per gli affari di Taiwan, Fu Cha non ha presentato appello e la sentenza è passata in giudicato a norma di legge: in quella versione, nel sistema giuridico cinese non resta alcuna via di ricorso ordinaria. Nemmeno la fine della pena ha sciolto il controllo: gli resta tuttora vietato espatriare e resta inoltre soggetto alla pena accessoria della privazione dei diritti politici, segno che le autorità conservano la capacità di identificarlo e di esercitare pressione anche dopo l'esecuzione della condanna. Per chi pubblica o scrive all'estero ma conserva in Cina una registrazione anagrafica o legami familiari, una pratica amministrativa di routine può diventare essa stessa il punto di rischio.
